The Movement – Terms & Conditions
1. Payments
- All services operate on a pre-pay basis. Sessions or programmes will only be delivered once payment has been made in full.
- Fees are billed monthly and due on the same date as the initial payment. Payment history is available in the App.
- If payment fails, access to services will be suspended until fees are brought up to date.
2. Packages & Commitments
- The Movement Online: 1-month rolling, 3-month minimum term, 30-day cancellation via email (jonathan.sparkes@hotmail.co.uk).
- Personal Coaching: 3-month minimum term applies (with or without a programme). 30-day cancellation notice via email.
- Ad-Hoc Packages: All credits expire after 12 weeks.
3. Cancellations & Rescheduling
- 30 days’ notice required to cancel any rolling or fixed-term package.
- 24 hours’ notice required to reschedule or cancel a booked session. Sessions cancelled late will be deducted from your package.
- If a session is cancelled by The Movement, it will be rescheduled or credited forward.
4. Session Credits
- Package credits will always be used before any ‘Additional Session’ credits.
- Additional Session credits are non-refundable.
- Missed sessions due to absence, holiday, or sickness must be used within the same month or carried over into the following month only.
- If carried-over credits cannot be used, a refund for those credits will be given once the following month’s fees have been paid.
5. Refunds & Price Changes
- Refunds are only issued at the discretion of The Movement, except where The Movement cannot deliver purchased sessions (in which case unused sessions will be refunded).
- Prices are subject to change with at least 30 days’ notice.
6. Session Standards
- Personal Coaching sessions are 55 minutes. Lost time due to lateness cannot be reimbursed.
- Clients are expected to complete an appropriate warm-up and cool-down. Guidance can be provided if required.
7. Health & Safety
- I understand results are not guaranteed. Progress depends on my effort and commitment both inside and outside sessions.
- I confirm my PAR-Q answers are accurate and I will inform The Movement of any changes to my health.
- I understand exercise carries risk. The Movement accepts no liability for injury except where caused by gross negligence or intentional act.
- To the maximum extent permitted by law, The Movement shall not be liable for any indirect, incidental, or consequential damages.
- I am responsible for ensuring I am medically fit to participate.
8. Conduct & Termination
- The Movement reserves the right to suspend or terminate services where terms are breached (e.g., repeated no-shows, non-payment, inappropriate behaviour).
9. Media Use
- Photos/videos may occasionally be taken during sessions for promotional use. Please inform your trainer if you do not wish to be included.
10. Force Majeure
- In the event of circumstances beyond The Movement’s reasonable control (including but not limited to gym closures, strikes, extreme weather, or public health restrictions), services may be adapted (e.g., rescheduled, moved online, or expiry extended) as a fair alternative to refunds.
11. Entire Agreement
- These terms represent the entire agreement between The Movement and the client and supersede any prior verbal or written agreements.
12. Severability
- If any provision of these terms is held to be invalid or unenforceable, the remainder shall continue in full force and effect.
13. General
- All bookings and purchases should be made through The Movement App (powered by MyPTHub).
- Jonathan Sparkes is a self-employed, independent Personal Trainer, Group Exercise Instructor, and British Weightlifting Coach. Your contract is directly with The Movement.
The Movement Inner Circle (WhatsApp Group) Terms & Conditions
As part of your coaching experience with The Movement, you will be invited to join our private WhatsApp community. This group is designed to provide motivation, support, accountability, and a safe space to share your journey. By joining, you agree to the following terms:
1. Privacy & Respect
- By joining the group, you consent to your mobile number being visible to other members.
- Do not use another member’s details (including their phone number) for any purpose unless explicitly agreed by both parties.
- Harassment, unsolicited messaging, or misuse of personal information is strictly prohibited.
- What is shared in the group should stay in the group. Please do not share screenshots, comments, or discussions outside without consent.
2. Conduct & Engagement
- This community exists to motivate, support, and encourage one another. A small positive comment from you could be the reason someone else finds their “why” again.
- Be kind, respectful, and inclusive in all interactions. Criticism must remain constructive.
- Offensive, discriminatory, or harmful language or behaviour will not be tolerated.
- No unsolicited advertising, promotions, or irrelevant content.
3. Purpose & Boundaries
- The group is here to help you feel supported when motivation is low, when you feel distant from the fitness world, or when you need a safe place to turn to.
- This group is not a replacement for professional medical advice. Always consult with a qualified professional for health concerns.
- The group is not monitored 24/7. For urgent coaching queries, please use the App or contact your coach directly through agreed channels.
4. Moderation & Removal
- The Movement reserves the right to remove any member from the group at any time if these terms are breached.
- Repeated or serious breaches may result in termination of your coaching services.
- If a member expresses concerns for their safety or wellbeing, The Movement may take appropriate action, including contacting emergency services if necessary.
5. A Shared Responsibility
- This is your community. It thrives when members respect one another, contribute positively, and uphold the values of support, encouragement, and inclusivity.
